CHRISTOPHER BARNETT’S PENALTIES / CLASS A MISDEMEANOR ANIMAL ABUSE

* 75 days’ jail time (similar cases usually get 48 hours, even though 11 months/29 days is possible)
* 100 hours of public (community) service
* Mandatory anger management class
* $5,071.50 in restitution costs for the care of Lucas to the Humane society of Warren County
* Restriction of no future ownership of domestic animals, with the exception of horses, as Mr. Barnett is a farrier by training and occupation
* Surrender of Mr. Barnett’s Boxer to the Humane Society (the Boxer has been in the custody of the Humane Society since the seizure of Lucas).

THE SENTENCING / 11 ANIMAL ADVOCATES WERE PRESENT

From Emilie Bottiggi, ebottiggi [at] aol.com — In January 2009, Christopher Barnett. of McMinnville TN (Warren County), was convicted of Class A Misdemeanor Animal Abuse. Barnett was accused/convicted in a jury trial of filing Siberian Husky Lucas’ teeth down to the gums.

Animal advocates present spoke to Attorney General Lisa Zavogiannis before sentencing. Judge Larry “Bart” Stanley, Jr. took all her recommendations (jail time less than full 11 months/29 days, but still more than expected!) Thanks to the many animal advocates who wrote, emailed, faxed, or called principal contacts. Thank you to Kinship Circle for notifying the wider animal advocate community about this case.

CHANCES FOR A NEW TRIAL AND APPEAL?

Mr. Barnett reports to jail on March 13, 2009. If he/his attorney file for a “new trial,” they must do so no later than March 11, 2009. We do feel confident that this conviction/sentencing will stand. We will not know until March 11 what Barnett and his attorney will do.

HOW IS LUCAS TODAY?

Lucas underwent multiple surgeries at Sparta Road Veterinary Clinic and recovered last year. Seven unsalvageable teeth were extracted and 16 root canals performed, relieving Lucas’ pain and allowing him to eat. The Warren County Humane Society oversaw Lucas’ adoption into a new family.

FELONY-CHARGED FIREMAN SUES “OWNERS” OF DOG HE KILLED RIVERSIDE, Calif. — A former Los Angeles County assistant fire chief who was charged with a felony after hitting a dog with a rock has sued the animal’s owners… Glynn Johnson, 54, has pleaded not guilty to felony animal cruelty stemming from his Nov. 3 clash with Karley, a 6-month-old German shepherd mix [who] was euthanized due to [her] injuries.

Johnson’s lawsuit claims negligence and intentional infliction of emotional distress. He is seeking unspecified damages from the owners… [Kinship Circle notes: For a psychopath, the guy has balls.]

JOHNSON’S NEXT COURT DATE: FEBRUARY 20, 2009

From Lindy Greene, lindygreene [at] roadrunner.com — Karley’s injuries: shattered jaw, crushed nose, gouged-out eye, collapsed ear canals, smashed skull. She was euthanized due to intense suffering… She’d have been permanently brain-damaged. Facial injuries were apparently achieved with bare hands, while those to the cranium were inflicted with a 11-inch rock. The puppy was hit repeatedly with the rock long after she’d stopped moving. Glynn Johnson sustained a cut thumb. He weighs 250 pounds (and is a trained firefighter). Karley weighed 45 pounds.

Also ask the Los Angeles Fire Chief about Johnson’s job status. Johnson has tried to portray himself as a trustworthy public servant, but there are allegations indicating otherwise.

    Hi y’all! I’m Lucas, and I have been in my forever home since January 16, 2009. I just want to say thank you for your support.

    Barnett’s sentence:
    * 11 months & 29 days in jail of which 75 days jail time must be served;
    *100 hours of public (community) service;
    *Attendance at an Anger Management Class;
    *Restitution of $5,071.50 in costs for the care of Lucas to the Humane society of Warren County;
    *Restriction of no future ownership of domestic animals, with the exception of horses, as Mr. Barnett is a farrier by training and occupation; and
    *Surrender of Mr. Barnett’s Boxer to the Humane Society
