BORDC Issues The “War on Terror” and The Constitution

The Northampton, MA, September 17, 2008 — “The ‘War on Terror’ and The Constitution,” a new booklet by the Bill of Rights Defense Committee (BORDC), is a concise summary of how key anti-terrorism laws and policies enacted since September 11, 2001, affect Americans’ constitutional rights. The new laws are organized into chapters corresponding to sections of the U.S. Constitution and articles of the Bill of Rights. Stories in each chapter show how the lives of innocent Americans and foreign detainees have been affected. BORDC is issuing the 24-page booklet on Constitution Day, the 220th anniversary of the U.S. Constitution.

Nancy Talanian, BORDC’s director and the booklet’s author, sees the booklet as a roadmap to show Americans the current status of their rights and liberties compared to where they should be according to the Constitution. “Armed with that knowledge,” she said, “they can work with one another and with their legislators to restore the essential rights they have come to expect.”

Nat Hentoff, a nationally recognized authority on the Bill of Rights, agrees. “No matter who the next president is or what the composition of the next Congress is,” he said, “the extent and the depth of what the Bush administration has done to the Constitution and to our standing in the world will remain unless and until enough Americans know how much remains to be done-and this booklet by the Bill of Rights Defense Committee provides the basic tools with which the citizenry can begin to act to make this America again.”

According to Talanian, “We now have substantial proof that human failures within our government, not the laws and policies in place prior to September 11, 2001, contributed to the terrorist attacks on that day. Furthermore, no proof has been offered to substantiate executive branch claims that new laws and policies such as the USA PATRIOT Act have made this country safer. One could argue that the government is wasting resources prying into the lives of innocent people and storing millions of their private records in databases and treating potentially all of us as terrorism suspects.”

In 2002, BORDC spearheaded a nationwide campaign that put city, county, and state governments on record for upholding their residents’ constitutional rights. The passage of eight statewide resolutions and more than 400 local resolutions and ordinances led Congress to strengthen its oversight when it reauthorized the PATRIOT Act in 2006. BORDC’s current focus is on the People’s Campaign for the Constitution, a grassroots effort to hold members of Congress accountable to their oaths to uphold the Constitution.

Coal River Wind: Email the Governor
The residents of the Coal River Valley in West Virginia urgently need your help. A few weeks ago, we told you about the Coal River Mountain Wind Project that proposes to install a wind farm on Coal River Mountain, rather than blow it up to extract coal. Our friends in Coal River Valley thought they had months to stop the proposed mountaintop removal coal mining operation at Coal River Mountain, but the coal company, Massey Energy (financed by Bank of America), circumvented the law, altered the permits, and is set to begin blasting the mountain for coal TODAY, September 10. If they are allowed to proceed, the blasting will eliminate much of the potential for production of clean wind energy and creation of good, green jobs on Coal River Mountain. They need our help. Call or email Gov. Manchin today and ask him to issue a “stay of execution” for Coal River Mountain.

Electronic Frontier Foundation (EFF): Keep Wireless Broadband on Track at the FCC
Within the next few months, the FCC is expected to decide the fate of cutting-edge wireless access through a proceeding titled “Unlicensed Operation in the TV Broadcast Bands”. Ideally, the FCC will permit new technologies to take advantage of unused “white space” spectrum to send and receive data wirelessly. Allowing open, unlicensed use could pave the way for faster, cheaper wireless broadband — leading to more ISP choices for consumers and a source of continued pressure for ISPs to maintain net neutrality.

AWI has learned that the Prevention of Equine Cruelty Act (H.R. 6598) will be voted on by the House Judiciary Committee on Wednesday, September 10th. The bill, which was introduced in July by Judiciary Chairman John Conyers (D-MI) and Representative Dan Burton (R-IN), will criminalize the slaughter of American horses. While the vast majority of Americans, the United States Congress and members of the House Judiciary Committee support an end to horse slaughter there are some members on the committee who are staunch supporters of horse slaughter and will attempt to kill the bill through subterfuge.

But in the current election we have an unusual media opportunity to make the animals’ voices heard. While most of the population are not vegetarian and may not rate animal issues at the top of their agenda, numerous polls have shown that the vast majority of Americans do care about kindness to animals. Defenders of Wildlife: Reject the Bush/Cheney Offshore Oil Scheme
The Bush/Cheney Administration has launched an all-out push to line our coasts with oil rigs that would pollute our waters, threaten dolphins and other marine wildlife and wreck coastal economies. According to federal energy officials, such drilling will have “no significant” impact on prices at the gas pump. But it would have significant impacts for dolphins, sea turtles and other marine wildlife that needs healthy ocean ecosystems to survive.

Democrats.com: No Stolen Election 2008
Democrats.com was born at the August 2000 Democratic convention in Los Angeles where Al Gore was nominated for President. That November, Karl Rove and Florida’s Secretary of State Katherine Harris stole the election. While the theft was in progress, we organized “Count Every Vote” protests all across the country, helped the Congressional Black Caucus formally object to the counting of Florida’s stolen electors (a scene made famous in “Fahrenheit 9/11″), and protested George Bush’s inauguration in Washington DC. Please help our friends at the Secretary of State Project stop Republicans from stealing the 2008 election.

North Atlantic right whales are among the most endangered whales found in US waters. The Endangered Species Act plays an important role in protecting these few remaining whales, but this landmark law is under attack. Greenpeace: Don’t gamble on offshore oil
Record high gas prices have been making headlines for the past few months, and some politicians and corporations are taking advantage of the dire situation by organizing a push to lift a 27-year moratorium on drilling for oil along our coastlines.
