“Sunshine is the best of disinfectants,” said Judge Louis Brandeis about the power of public scrutiny to scrub clean the dark corners of government abuse. The American Society of Newspaper Editors has named March 16-22 of this year “Sunshine Week”, a week-long assertion of the public’s right to know what its government is doing.

The week’s events include:

* March 14 – A National Freedom of Information Day Conference, sponsored by the First Amendment Center;

* March 17 – A National Freedom of Information Day Celebration, sponsored by Collaboration on Government Secrecy;

* March 18 – Remarks by Associated Press President Tom Curley at the National Press Club;

* March 19 – Webcast Government Secrecy: Censoring Your Rights with Mickey Edwards, from the Aspen Institute, and former Republican member of Congress from Oklahoma; Ann Beeson, from the Open Society Institute, formerly with the American Civil Liberties Union; and John Podesta from the Center for American Progress, formerly president Clinton’s Chief of Staff. From 1 to 2:30 p.m. EST at the Washington Press Club, and also available online.

* March 20 – Professor Lawrence Lessig on corruption in government, sponsored by the Sunlight Foundation.

In 2007, Sunshine Week marked an effort by Congress to pass “sunshine” legislation, such as:

* A bill protecting whistleblowers (H.R. 985), which passed the House 331-94 on March 14, 2007. The bill has not made it out of committee in the Senate.

* A Freedom of Information Amendments Act (H.R. 1309), which passed the House 308-117 on March 14, 2007. H.R. 1309, however, was unable to make it through the Senate, so in mid-December, Senators Patrick Leahy (D-VT) and John Kyl (R-AZ) pushed through a moderated version (S. 2488) on voice votes, which became law on December 31.

Just read on Green Is The New Red that the two captured Sea Shepherd crew members have been released, relatively unharmed.

Here’s Will with the details:

Two anti-whaling activists that have been held hostage by Japanese whalers were released today, after the Australian government intervened. […]

Benjamin Potts, 28, and Giles Lane, 35, were transferred to an Australian vessel, the Oceanic Viking. According to a statement (and the video above), they were roughed up a bit when they boarded but otherwise weren’t harmed.

Gabriel Gonzalez, a spokesman for The Institute of Cetacean Research in Tokyo (the whalers, gotta love the misleading name) told The Telegraph that the two were initially tied up because they might have been carrying bombs or weapons.

“This is a terrorist organisation, let us be clear of that, and if they respond with aggressive tactics, who knows what might happen,” he said.

So let’s get this all straight. Two activists board a ship, with a letter of intent, because the whalers refused to respond to radio communications. Whalers rough them up, tie them up, and then Yasuaki Sasaki, the captain, makes a series of demands, including activists must stop filming the whalers’ activities and not come within 10 nautical miles of the whaling ship.

But the anti-whaling advocates are the terrorists?

Just before the December recess, the Senate came dangerously close to a floor vote on the Senate Intelligence Committee’s version of S. 2248, the Foreign Intelligence Surveillance Act (FISA) Amendments Act. That bill was touted as a “fix” of the so-called “Protect America Act” (PAA, or more accurately, the Police America Act). The PAA was rushed through Congress last August, legalizing executive branch domestic wiretapping without warrants.

Warrantless wiretapping started BEFORE 9/11

It’s incredible that even after learning that the Bush Administration began its warrantless wiretapping program as early as February 2001 — well before 9/11 — Congress would consider rubberstamping the administration’s and telecom companies’ FISA violations. But that’s exactly what Congress is considering. The Senate Intel Committee’s S. 2248 not only falls short of restoring critical Fourth Amendment privacy protections, but it would grant retroactive immunity to telecommunications companies that enabled the Bush administration’s warrantless wiretapping program, endangering the lawsuits that have been moving through the courts.

EFF: Improve the Freedom of Information Act!

Senator Jon Kyl (R-AZ) has placed a not-so-secret hold on bipartisan legislation that would strengthen the Freedom of Information Act (FOIA) and the public’s right to know. The OPEN Government Act (S. 849) would, among other things, provide FOIA requesters a tracking number enabling them to follow the status of their request and impose reasonable consequences on federal agencies that missed deadlines for complying with FOIA.

The bill, sponsored by Senators John Cornyn (R-TX) and Patrick Leahy (D-VT), passed in the Senate Judiciary Committee. And the House of Representatives recently passed similar legislation by an overwhelming bipartisan vote. Senator Kyl’s hold is now the only thing stopping this bill’s passage.

Please contact your Senators and urge them to pressure Senator Kyl and the Senate Republican leadership to take his hold off this popular bipartisan bill.


The following is an excerpt from the Electronic Frontier Foundation’s latest newsletter:

An Independence Day Resolution: Reform FOIA!

On July 4, 1966, President Lyndon Johnson signed the FOIA into law. FOIA gave weight to a principle that is fundamental to any democracy: the right of the people to know what the government is doing. Forty-one years later, FOIA remains an essential tool used by the public, public advocacy groups (including EFF), and news organizations to uncover information that would otherwise remain hidden from public view.

But a recent report from the George Washington University’s National Security Archive and the Knight Foundation shows that FOIA is far from a perfect tool of transparency in government. The study found that requests for information often languish in bureaucratic limbo for years — the oldest dates back to 1987! The National Security Archive actually had to use FOIA to find out how many FOIA requests were still pending.

Luckily, a new bill to reform FOIA is working its way through Congress, supported by a broad coalition of organizations that spans the political spectrum. The OPEN Government Act (S. 849) brings much needed reform to FOIA and puts in place incentives for federal agencies to process FOIA requests in a timely fashion. The bill would create a tracking system for FOIA requests so that they don’t get lost in the bowels of federal agencies, as well as allowing requesters who prevail in FOIA litigation to recover reasonable attorney fees.

Meanwhile, EFF’s FOIA lawsuits are making steady strides. Along with uncovering information about National Security Letters, we’ve filed suit seeking orders, rules and guidelines issued by the Foreign Intelligence Surveillance Court about the Administration’s warrantless surveillance program. There will be a hearing in the case on July 26 in Washington, DC.

Novelist Caroline Paul comes from a family committed to activism. Her Baywatch-famous sister Alexandra was in “Who Killed the Electric Car,” hosts a TV talk-show on environmentalism, and comes out in support of numerous animal causes. In today’s (Thursday May 24) Los Angeles Times op-ed piece headed, “My brother, the ‘terrorist'” we learn that their brother, Jonathon “is considered one of the biggest domestic terrorists in the country.” Paul gives us some warm personal details about his past, and then writes, “most important, he has devoted his life to stopping animals’ suffering. To this end, he has broken the law. He crept into animal laboratories to free dogs. He dismantled corrals to release wild mustangs. He impersonated a fur buyer to film the treatment of minks. He put himself between whales and whalers despite warnings that his boat would be impounded and that he would be jailed. And nearly 10 years ago, he burned down a horse slaughterhouse in Redmond, Ore. It is for this final act that the U.S. government considers him among the ranks of Osama bin Laden, Eric Rudolph and Ramzi Ahmed Yousef.”

She continues:

“My brother, Jonathan Paul, has pleaded guilty in U.S. District Court in Eugene, Ore., to burning the Cavel West Slaughterhouse. He will find out on June 5 whether the judge considers his actions deserving of the ‘terrorism enhancement’ to his sentence sought by the government.”

Paul does not take arson lightly. She writes, “I was a San Francisco firefighter for 13 years. I was angry and dismayed that my brother chose arson as a route to stop animal suffering. But ‘a classic case of terrorism’?”
